GENERAL TERMS AND CONDITIONS OF SALE - BIOTULIN

I - Acceptance of the terms and conditions The site www.biotulin.com (the "Site") is an e-commerce site. It is published by the company LORIENCE ("the seller"), a public limited company, whose registered office is located at 50, avenue de la Grande Armée 75017 Paris, registered in the companies register under the number 43439852500023.

It is hosted by Shopify. The Site enables the seller to offer perfumes for sale to Internet users browsing the Site. Any order for a Product offered on the Site implies consultation and express acceptance of these general terms and conditions of sale, without this acceptance being conditional on a handwritten signature by the User. Validation of the order form constitutes an electronic signature which, between the Parties, has the same value as a handwritten signature. The User may save or print these general terms and conditions of sale, provided that they are not modified. These general terms and conditions of sale are valid from 1st June 2010. The seller reserves the right to modify these terms and conditions of sale at any time and without prior notice. However, any changes will not apply to reservations and orders previously accepted and confirmed by the buyer. These conditions apply to the exclusion of any other document. The user declares that he/she has no intention of reselling the products purchased.

II - Products marketed All product offers proposed on the Site are limited to the countries for which the site authorises them. Promotional offers are only valid within the double limit of the validity period of the offer concerned and available stocks.
Before placing an order, the Buyer may check the essential characteristics of the product(s) he/she wishes to order on the Site. If one or more products are unavailable after the order has been placed, you will be notified by e-mail. You may also cancel an order placed on the site by contacting Customer Services on telephone number 02 37 23 10 17.
The photographs, graphics and descriptions of the products offered for sale are indicative only and are in no way binding on the seller.

III - Prices Prices are given in Euros, inclusive of all taxes, and are subject to change during the year. Products ordered are invoiced at the prices in force when the order is registered. They do not include shipping costs, which are invoiced in addition to the price of the products purchased, depending on the amount of the order. Shipping costs will be indicated before the Buyer places the order.

IV - Orders All orders imply unreserved acceptance of these general terms and conditions of sale. When the order is confirmed, the Buyer declares that he/she accepts the order and these general terms and conditions of sale. As soon as the order has been registered, a detailed acknowledgement of receipt will be sent to the Buyer at the email address indicated. This acknowledgement of receipt will specify the exact amount invoiced and the terms of delivery of the order, and will constitute acceptance of the order and validation of the transaction. The seller reserves the right to cancel any order for any legitimate reason.

V - Payments All orders are payable in euros. The Buyer may pay by the following credit cards accepted on the site: Visa, Master Card, Carte Bleue, Visa Electron, Maestro, Paypal or Klarna. The seller reserves the right to suspend or cancel any order in the event of non-payment of any sum due by the Buyer. Delivery of any new order may be suspended in the event of late payment of a previous order, notwithstanding the provisions herein.

VI - Delivery The products are delivered by DHL to the address indicated by the Buyer on the order form or to the point of withdrawal chosen by the Buyer. Delivery will be made within an average of 2 to 8 days from receipt of the order form, depending on the delivery method chosen. Delivery times are indicative. Under no circumstances may any delays give rise to the payment of damages by the seller. Customs taxes, in particular import taxes or excise duties, which may be due, are in all cases payable by the recipient and may not give rise to any claim or request for compensation from the seller.

VII - Return and refund of products Products may be returned by the Buyer in strict compliance with the conditions and instructions below:
- Products must be returned in perfect condition for resale, in their original state (packaging intact and unopened, accessories, instructions, etc.), and accompanied by the signed returns form.
- The seller will accept the return if it is returned within 14 days from the date of receipt of the order by the Buyer.
- Postage costs for the return package are at the Buyer's expense, except in the case of a non-conforming product or an error in the references delivered. In this case, the return costs will be reimbursed by the seller. Return instructions and procedure:
- Use the original packaging to return the product.
- Complete and attach the "Returns Form" (on the back of the invoice). Returns without the above-mentioned form will not be accepted.

The risk linked to the return of the product is the responsibility of the Buyer. If the procedure and deadlines indicated are not respected, the Buyer will not be able to make any claim for non-conformity or apparent defect of the products delivered, the products then being deemed to be in conformity and free of any apparent defect.

VIII - Withdrawal In the context of distance sales to consumers falling within the scope of the law of 14 July 1991, amended by the law of 25 May 1999, the consumer has the right to notify the seller that he/she renounces the purchase, without penalty and without giving any reason, within seven working days from the day following the day of delivery. If this option is exercised, the buyer will return the goods to the seller in their original condition at his own risk and expense, with a view to reimbursing the seller for the goods. The return and reimbursement of the products will take place on condition that the return instructions and procedures described in point 7 above are complied with. The refund will be made by credit card within 15 days of receipt of the parcel.

IX - Liability The seller may not be held liable for non-performance of the contract in the event of the product being out of stock or unavailable due to a case of force majeure, disruption or strike, in particular of the postal services and means of transport and/or communications. The seller may not be held liable for any indirect damage that may arise from the purchase of products. The seller declines all responsibility: - for any interruption of the site or occurrence of "bugs" - for any inaccuracy or omission concerning the information available on this site.

X - Applicable law and jurisdiction Disputes relating to the conclusion, validity, interpretation or performance of the contract are governed solely by French law. In the event of a dispute, the courts of the seller's registered office shall have sole jurisdiction.

XI - Personal data By simply placing an order on the seller's website, the buyer authorises the seller to process his/her personal data and to use it for purposes such as customer administration, order management, delivery and invoicing, solvency monitoring, marketing and advertising. The use of this data for marketing purposes or personalised advertising is subject to the prior agreement of the customer, given during the order procedure.

The company LORIENCE undertakes to communicate this data only for the needs of its subsidiaries, to the exclusion of any other third party. The customer who has ordered on the site may at any time ask to consult and correct the personal data recorded. The customer has the right to oppose, on request and free of charge, the processing of data for direct marketing purposes.

No information is collected without the Internet user's knowledge, nor is it used for purposes other than those for which it was intended, nor is it passed on to third parties. Hypertext links to the Site may only be created with the prior written authorisation of LORIENCE, which may be revoked at any time. LORIENCE declines all responsibility for the content of sites linked to the LORIENCE Site.

III - Nullity - partial nullity of clauses
If any part of these Terms is deemed invalid, that part will be interpreted in accordance with French law in the broadest possible manner. If one or more provisions of the Conditions become or are declared null and void by a competent court, this or these provisions will be null and void and considered deleted. All other provisions contained in these Terms shall remain in full force and effect. This site is subject to French law.

IV - Access to the site 

The LORIENCE E-Commerce sites are accessible 24 hours a day, 7 days a week, except in cases of force majeure, technical and/or IT and/or telecommunications difficulties and/or maintenance periods.
